PRIVACY STATEMENT

This Privacy Statement is a legal agreement between you and Stelpro Design inc. (“Stelpro”) and applies to your use of Stelpro’s AlliaTM Smart Home Solution, mobile application and products (“Solution”) and Solution software (“Software”, which includes the services furnished through the use of the Software), which may be used in connection with the Solution.
BY ACCESSING AND USING THE SOFTWARE, YOU AGREE THAT YOU HAVE READ, AGREE WITH AND ACCEPT ALL OF THE TERMS AND CONDITIONS IN THIS PRIVACY STATEMENT, AND ANY REVISED OR RENEWED VERSIONS THEREOF, AS WILL BE PUBLISHED ON STELPRO’S WEBSITE. IN THE EVENT OF ANY ERROR, OMISSION OR OTHER DISCREPANCIES BETWEEN THIS PRIVACY STATEMENT AND ANY AMENDMENTS OR ADDENDUMS ACCOMPANYING THIS PRIVACY STATEMENT AND THE PRIVACY STATEMENT MADE AVAILABLE BY STELPRO ON ITS WEBSITE, THE TERMS OF THE LATTER SHALL PREVAIL. YOU MAY NOT MODIFY THIS PRIVACY STATEMENT BY MAKING ANY TYPED, HANDWRITTEN, OR ANY OTHER CHANGES TO IT FOR ANY PURPOSE.
YOU AGREE THAT YOU ARE THE END-USER OF THE SOFTWARE AND YOU REPRESENT THAT YOU ARE OF LEGAL AGE AND ARE AUTHORIZED TO ENTER INTO THIS PRIVACY STATEMENT ON BEHALF OF YOURSELF AND ANY PARTY TO WHOM YOU GRANT ACCESS TO THE SOLUTION AND/OR SOFTWARE.
1. Application
This Privacy Statement is intended to describe how Stelpro collects, uses and discloses information.
For the purpose of this Privacy Statement, the term “Personal Information” refers to information about an identifiable individual and includes or may include the name, home address, phone number, email, cell data and IP address.
This Privacy Statement does not apply to information or Personal Information collected by third parties and suppliers of other software, products and/or applications that you decide to use and integrate with the Solution (please see Section 9 below for more details).
2. Use and disclosure of the information
Stelpro collects information such as your name, address, email and phone numbers when you register and access the Software and through the connectivity established between you and Stelpro. This information will allow Stelpro to contact you in case of need, to send you alerts and reminders or to send you other informations that you may request.
Stelpro will also use your location to allow the Software to determine the nearest local weather information and to make available certain of the Solution’s functions such as geo-fencing capabilities.
To enable the Solution to function, Stelpro collects information on how and when you use the Software and Solution and data that relates to the Solution and Software, including without limiting the generality of the foregoing, indoor and outdoor temperatures, date and specific time of Solution’s or Software’s events. By using some functions of the Software and Solution, Stelpro, will collect from time to time, additional information including information about your heating, ventilation and air-conditioning system, the use of the products and/or services connected with the Solution and/or Software, the size of your house and various general household information. Stelpro may also aggregate information anonymously with information from other users to generate comparative data reports and anonymous databases for statistical purposes that will benefit the performance of the Solution. Stelpro may also use the information in aggregate form, without reference to your Personal Information, to help Stelpro develop additional services that are likely to be of interest to its users.
Stelpro also collects information through its mobile application installed on your device, including for example survey responses, device information, IP addresses and data stored in cookie files.
Stelpro will use the collected information to provide the services and operate the system, improve its products and services and the Solution, respond to your questions about its products or services or the Solution, identify your request when placing an order or registering for warranty or for warranty service to complete that order or service registration and to provide you with information about other Stelpro solutions, products and promotions that may be of interest to you.
Stelpro will not disclose your Personal Information to third parties without your consent, unless this third party is a consultant, supplier or a representative of Stelpro for the Solution or Software. Stelpro may share your Personal Information with its suppliers to operate its business and the Solution and/or Software, including without limitation in relation with handling user authentication, servicing the application and Software, customer service, analysis and storage of data, and Stelpro will ensure that its suppliers protect your Personal Information.
Stelpro may publicly disclose, share and/or sell the information in aggregate form, without reference to your Personal Information, and reports and analyses based on such information to third parties, including utilities, service providers, suppliers, advertisers, merchants, consumer and market research companies and other organizations.
3. Updating your Personal Information
You can access your Personal Information through the Software and you can update such Personal Information via the Software or by contacting Stelpro’s Customer Service. Stelpro will update any changes to Personal Information when received. If Stelpro holds Personal Information about an individual which can be established by the individual to be inaccurate, incomplete or not up-to-date, Stelpro will take reasonable steps to correct it.
4. Opposition and withdrawal
Stelpro is committed in providing you with the right to oppose and withdraw your Personal Information.
You may oppose to the disclosure by Stelpro of your Personal Information to third parties at the time of collection or at any time thereafter. You may also withdraw your consent to the use or disclosure of your Personal Information for any identified purpose at any time but if you withdraw, you may not be able to use the Solution, the Software and/or certain products, services and functions in relation with the Solution and/or Software.

You should contact Stelpro’s Customer Service for more information regarding the implications of such opposition or withdrawal.
5. Access
If you would like to access your Personal Information, or request that your Personal Information be modified, corrected or removed from our database, please contact Stelpro’s Customer Service at [email protected], or by mail at Stelpro Costumer Service – Privacy, 1041 Parent Street, Saint-Bruno-de-Montarville, Province of Quebec, J3V 6L7.
To protect your privacy and security, Stelpro will also take reasonable steps to verify your identity before granting access or making corrections. Stelpro will use reasonable efforts to supply you with this information and to correct any factual inaccuracies that you identify.
Where there is a cost for access to Personal Information, Stelpro will provide you with an estimate of the approximate cost. Upon receipt of the estimate, you must advise Stelpro if you wish to continue with the request. The request will be put on hold until such time as Stelpro receives confirmation to proceed with the request based on approval of the fees involved.
6. Usage and/or storage outside of Canada
Your Personal Information may be used or stored by Stelpro or its service providers in Canada or in the United States of America. Stelpro takes reasonable contractual or other measures to protect customer’s Personal Information while processed or handled by these service providers and its corporate affiliates which are responsible and liable if they misuse any Personal Information.
7. Transfer
Stelpro reserves the right to transfer your information in the event it sells or transfers all or a portion of its business or assets and Stelpro will take all reasonable steps to ensure that the privacy of your Personal Information will be preserved.
8. Security
The Personal Information collected by Stelpro is kept in a secure environment and its employees are required to respect the privacy of your Personal Information.
Stelpro undertakes to maintain a high level of confidentiality of your Personal Information by integrating security technological innovations which help to ensure the security of your Personal Information.
9. Third party products and solutions
By using the Solution, you may decide to integrate additional home automation devices and products and voice assistant features, manufactured and/or distributed by Stelpro but also by other third party suppliers and/or manufacturers, offered or not via the Solution. This integration may require that you provide your Personal Information to the suppliers and/or manufacturers of such devices and products, which may collect, use and store your Personal Information. This integration and the use of such additional products and solutions may require you to consent to the terms and conditions of use and service issued by their suppliers and manufacturers, including for example and without limitation, Weather station features (currently provided by Netatmo), Smoke detector features (currently provided by BRK Brands inc.), voice assistant features using a voice assistant (including those provided by Amazon and Google).
YOU ACCEPT AND AGREE THAT STELPRO DOES NOT ASSUME ANY LIABILITY IN RELATION WITH THE PROTECTION OF YOUR PERSONAL INFORMATION BY SUCH THIRD PARTY SUPPLIERS AND/OR MANUFACTURERS AND YOU ARE RESPONSIBLE TO ENSURE THAT SUCH THIRD PARTIES AND SUPPLIERS PROTECT YOUR PERSONAL INFORMATION.
10. Modification
Stelpro reserves the right to modify, add or remove portions of this Privacy Statement at any time and from time to time, acting in its sole discretion. If Stelpro decides to change this Privacy Statement, Stelpro will post those changes on its website (www.stelpro.com) or send a notification via electronic communication.
